Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HealthGuard AI application, website, and related services (collectively, the "Service") operated by Fabeco Kft. ("we", "us", "our"), H-6000 Kecskemét, Katona József utca 3. fszt. 1., Hungary.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 16 years old to use HealthGuard AI.
• By using the Service, you represent that you have the legal capacity to enter into a binding agreement.
• If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

HealthGuard AI brings together five areas of AI-powered tools for everyday health and wellbeing:

• Fitness: workout guidance, on-device movement analysis with form feedback and repetition counting, and chair yoga
• Meals: meal and fridge photo recognition, nutrition tracking, allergen-aware recipes and shopping lists
• Mind: a private mood journal on a 0–10 scale, breathing and meditation sessions, and a supportive AI companion for text-based reflection
• Recovery: guided rehabilitation exercises with on-device range-of-motion measurement and pain tracking
• Skin: a photo record of the skin spots you choose to track, with AI-assisted observations over time
• Progress tracking and a history of your entries in every area
• Optional Lab & Report Analysis: a plain-language, educational summary of a medical report you choose to upload — never a diagnosis

3. Account Registration

• You must provide accurate, complete, and current information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
• One person may not maintain more than one free account.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Upload content that is obscene, harmful, or violates third-party rights
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Scrape, crawl, or extract health data or user data from the Service by automated means
• Reproduce, resell, or redistribute any part of the Service without prior written permission
• Upload malicious code, viruses, or any software designed to interfere with the Service
• Create fake accounts, manipulate the rating system, or engage in any form of fraud
• Use the Service to make medical or clinical diagnoses
• Share your account credentials or allow others to use your account

6. Intellectual Property

All intellectual property rights in and to the Service — including the application design, AI models and prompts, the movement-analysis, nutrition, mood and skin-tracking features, user interface, and all associated content — are owned exclusively by Fabeco Kft. and its licensors.

You may not, without express written permission:

• Reproduce, copy, or reuse any portion of the application or its code
• Reverse engineer, decompile, or attempt to derive source code or algorithms
• Create derivative works, modifications, or adaptations of the Service
• Use HealthGuard AI name, logo, or branding without prior written approval

Your content: The entries, photos and personal data you add remain yours. By using the Service, you grant us a limited licence to process and store your content solely for the purpose of providing the Service to you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any specific results will be achieved through use of the Service. AI-generated content may contain errors or inaccuracies.

9. Termination

• You may close your account at any time by going to Account Settings → Delete Account.
• We reserve the right to suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or misuse the Service.
• Upon termination, your right to use the Service ceases immediately. We will delete your personal data within 30 days in accordance with our Privacy Policy.
• Sections 7, 8, 9, 11, and 12 survive termination of these Terms.

10. Governing Law & Dispute Resolution

• These Terms are governed by the laws of Hungary. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence.
• For EU/EEA users, mandatory consumer protection provisions of your country of residence also apply.
• Any disputes shall first be attempted to be resolved through good-faith negotiation.
• If negotiation fails, disputes shall be settled by the competent court of Hungary. If you are a consumer, you may also bring proceedings before the courts of your country of residence.
• EU consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will provide at least 30 days notice via email or an in-app notification before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
